She almost lost him via "legal kidnapping" by a devil of a man obsessed with her son and spun lies to the boy, the family, and the courts. It was looking very grim and within a few days of my mother's death everything turned around! My nephew is back with his family where he belongs... The purpose of imprisonment is to cause affliction.
A mental condition.
This is most obvious in the case of non-violent crimes, such as financial crimes. Because people should restore their victims. Give them their money back. Give the exact value back is difficult. But if the criminal is in prison, he cannot work to give back what he has destroyed.
It's a dumb and wasteful method. It only produces the tantalizing pleasure of sadism, the weird joy of seeing another person suffering beyond necessity.
In the case of murderers, it's not worth to keep them around. Imagine a case where a 20 year old man tries to steal something and kills a person. Is he going to spend 20, 30, 40 years in prison? Maybe he learns something, changes his mind, etc. Maybe he doesn't. Maybe he becomes worse. In some cases, maybe it would be better to kill him. Not that his execution can restore the life of his victim. But better only because there is less sadism in a rapid execution. Besides the expenses and possible slavery of keeping a murderer alive for 20 years or more, there is a greater risk: what if the sadism of that punishment causes people to become worse? to become sadists in their personal lives? What if a rapid execution spares a nation from having many people mentally disturbed, causing problems everywhere, because now they are sadists, because they have been working to pointlessly disturb a prisoner for many years?
Not that the death penalty is not without problems. But for violent crime, the alternative may cause more trouble.
And the sadism of the prison system also extends to non-violent criminals.
And the corruption of the criminal law regarding non-violent criminal overflows the prison system and ends up affecting everyone else. In the perturbed mindset of police men and prosecutors, everyone is a per-criminal, and deserves affliction already just by being alive.
