My view is that this is way beyond a civil matter, it's criminal, and therefore the legislated immunity should have no bearing. The route to take, given sovereign immunity, is to request permission from the Attorney General of the US to file the lawsuit, otherwise the lawsuit is precluded. See the Primer cited above. And yes, I am a lawyer.
